Update: Overseas Investment Act – Forestry Review
We recently provided input to the Overseas Investment Act - Forestry Review and have the following update from Te Tai Ōhanga – The Treasury.
The Overseas Investment Act Forestry Review was released by Associate Minister of Finance, Hon David Parker on 11 August 2022 here. Of note is the amendment to the Overseas Investment Act that removes forestry conversions from the ‘special forestry test’ in the Act and requires them to go through the ‘general benefit to New Zealand test’ instead.
Whilst this change will make investment, and in particular land purchase, more onerous for offshore investors, the ‘general benefit to New Zealand test’ is aligned to Māori Landowner empowerment and therefore should remain a viable option for investment in Tangata Whenua.
